1. Acceptance of Terms
By accessing and using the Whitewater Hydrovac website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. Services
Whitewater Hydrovac provides hydrovac excavation, potholing, slot trenching, debris removal, industrial cleaning, cold weather excavation, and emergency response services in Colorado. All services are subject to availability, site conditions, and applicable regulations.
3. Quote Requests
Quote requests submitted through our website are not binding contracts. All quotes are estimates based on the information provided. Final pricing is determined after site assessment. We reserve the right to decline any project.
4. Service Agreements
Formal service agreements are required for all projects. These agreements outline scope of work, pricing, timeline, payment terms, and liability provisions. Work begins only after a signed agreement is in place.
5. Payment Terms
Payment terms are specified in individual service agreements. Standard terms are net 30 for commercial clients. Residential projects may require deposit. Late payments are subject to interest charges as specified in the service agreement.
6. Liability Limitations
Whitewater Hydrovac's liability is limited to the value of services provided. We are not liable for pre-existing conditions, inaccurate utility locate information, or circumstances beyond our control. We carry comprehensive general liability and workers' compensation insurance.
7. Colorado 811 Requirements
Clients are responsible for ensuring all required utility locates are completed before scheduled work. Whitewater Hydrovac will not begin excavation without confirmation that 811 locates have been requested and completed.
8. Intellectual Property
All content on this website, including text, images, logos, and design, is the property of Whitewater Hydrovac and is protected by copyright law. Unauthorized use is prohibited.
9. Governing Law
These terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the courts of El Paso County, Colorado.
